Spain Non-Lucrative Visa

Spain is a country with a pleasant climate, a high standard of living, and affordable housing prices. Foreigners with a residence permit for financially independent persons can live in Spain permanently and travel within the Schengen Area without a visa.

Financially independent persons can obtain a residence permit in Spain through a national D visa, the Non-Lucrative Visa.

A Passive Income Visa in Spain does not allow employment. It is assumed that the applicant receives income from abroad sufficient to live in the country. Foreigners may register a business in Spain, but they are not allowed to work for the company — only to receive dividends.

To obtain a residence permit, applicants must confirm passive income of at least €28,800 per year. Sources of income may include savings, rental income, dividends, or a pension.

Family members may apply for a residence permit together with the main applicant. In this case, the income requirement increases by €7,200 for each additional family member included in the application.

The applicant must also register at a place of residence in Spain. This can be done by renting or purchasing property — there are no requirements regarding the value or size of the property.

The first residence permit card is issued for one year; subsequent cards are valid for two years.

How to obtain residence permit in Spain: step-by-step process

1.

Preliminary check

This stage is required to assess potential risks, such as refusal of a visa or residence permit. A certified compliance specialist reviews the applicant’s documents and evaluates possible risks. It helps identify potential issues and find solutions in advance.

2.

Document preparation

Pasportivity’s lawyers prepare an individual list of documents. The applicant collects the original documents. The lawyers translate them, notarize copies, and apostille the required documents.

3.

Property selection for purchase or rent

Applicants must purchase or rent residential property in Spain; there are no requirements regarding the size or value of the property. Pasportivity’s real estate experts help select a suitable property and conclude a lease or purchase agreement.

4.

Obtaining a D visa to enter Spain

Once the document package is ready, the lawyers book an appointment for the applicant at the Spanish consulate in the country of citizenship or residence. There, the applicant submits an application for a national D visa. This visa is required to enter Spain, provide biometrics, and apply for a residence permit.

When submitting documents for the additional visa application, the applicant must pay a consular fee of €80.

The visa application is reviewed within 90 days. After approval, the visa is affixed to the passport and is valid for 90 days.

5.

Travel to Spain to apply for a residence permit

Within three months, the foreign national must enter Spain on the D visa and then submit documents for a residence permit to the foreign nationals’ registration office or a police station.

6.

Obtaining the residence permit card 🔥

Documents for a Spanish residence permit are usually reviewed within a few weeks, but in some cases the process may take several months. Once the application is approved, the foreign national receives a residence permit card.

The residence permit card is valid for one year and can then be renewed for two years.

How to renew a residence permit for financially independent persons in Spain

The first residence permit card in Spain is valid for one year. The resident has the right to renew the status twice, each time for two years. An application for renewal must be submitted 60 days before the expiration date, but no later than 90 days after the residence permit expires.

From May 20th, 2025, holders of a residence permit based on financial independence will be required to spend at least 183 days per year in Spain in order to be eligible to apply for a renewal. They will also need to confirm that they continue to meet the conditions for holding a residence permit:

  • renting property;
  • receiving passive income;
  • being able to support their family in Spain.

The residence permit is renewed immediately for 2 years, so residents must confirm passive income sufficient for this period, at least €57,600. The income requirement increases by €14,400 for each family member.

How to obtain permanent residence and Spanish citizenship

Permanent residence is obtained after 5 years of living in the country with a residence permit. The applicant must prove that during this time they did not leave Spain for more than 10 months in total and spent at least 183 days per year in the country.

Permanent residence status is granted for life, but the resident card itself must be renewed every 5 years.

Spanish citizenship is obtained by naturalization after 10 years of living in the country. Applicants must pass exams confirming knowledge of the Spanish language at A2 level or higher, as well as the country’s laws and culture.

Spain does not recognize dual citizenship, so a foreign national must renounce other passports. Exceptions apply to citizens of France, Portugal, Andorra, and Latin American countries.
